Law legitimizes genocide by criminalizing Kashmiri identity itself. [causal]
In December 2021, my friend Professor Farhan Chak, a Kashmiri leader for self-determination, convened the first Russell Tribunal on Kashmir. It was held, appropriately, in Sarajevo, Bosnia and Herzegovina—another site of Muslim genocide. Among Kashmiri leaders, our Bosnian hosts, and committed friends, I spoke: "In Kashmir—at this very moment—law sits at the very center of a two-faced genocide just as concerned with murdering a culture, a history, an identity as it is with murdering the Kashmiri bodies whose very existence—whose very being—is an act of rebellion and expression of 'terrorism' to an imperial, occupying, and genocidal Indian regime."
XREF: Connects to the Russell Tribunal history and to legal scholar arguments about law as an instrument of occupation, e.g., lawfare scholarship.
